Iranians Of Western Australia Website ("IWA") may in its sole discretion change, modify, add, or remove portions of these Terms at any time without notice.
1. Ownership and Reproduction of IWA Materials; The contents of this web site (including the property of IWA and other third parties, the "IWA Materials") may not be copied, reproduced, republished, downloaded, posted, transmitted, or distributed, in whole or in part, for any purpose other than individual viewing of this web site, without the express prior written consent of IWA or the relevant third party. Modification of the IWA Materials or use of the IWA Materials for any purpose will constitute a violation of the copyrights and other rights of IWA. For purposes of this Agreement, the use of any IWA Materials on any other web site or networked computer environment is prohibited. You are hereby granted a limited, non-transferable, non-exclusive, non-sublicensable license to display the IWA materials for non-commercial purposes only on your own computer, provided that this license is limited to the display of the IWA Materials in their entirety, including but not limited to visual elements such as advertisements that adjoin content. Any attempts to access the IWA Materials in a manner that obscures or blocks such adjoining visual elements is a violation of the license granted hereunder and may be a violation of the Copyright Act.

2. Linked Sites. IWA, whether affiliated or not affiliated with sites linked to this site ("Linked Sites"), is not responsible for their content. The Linked Sites are for the convenience of the user only, and may be accessed by the user only at the user's own risk. Transactions with advertisers found on any IWA website pages are solely between you and such advertisers. IWA shall not be responsible for any loss or damage of any sort relating to your dealings with such advertisers.
3. Content of Submissions. The user shall not submit to us and to this site any materials which (a) libel, defame, or invade the privacy of any third party, or which are obscene or pornographic; (b) infringe the intellectual property rights, including copyrights, of any third party; (c) violate any law or regulation; (d) advocate illegal activity; or (e) advertise or otherwise solicit funds or are a solicitation for goods or services. The user agrees to indemnify IWA and its officers, directors, employees, and affiliates from and against any and all third party claims, demands, liabilities, costs, or expenses, including reasonable attorneys' fees, resulting from user's submission of any materials in violation of the foregoing restrictions. You shall not submit any data or information that contains viruses or any other computer code, corrupt files or programs designed to interrupt, destroy or limit the functionality or disrupt any software, hardware, telecommunications, networks, servers or other equipment.

4. Ownership of Submissions. IWA asks that the user not send IWA any original creative materials such as stories or original artwork. While IWA values users' feedback on this site, IWA requests that users be specific in their comments on the site, and not submit any creative ideas, suggestions, or materials. If users do send IWA creative suggestions, ideas, notes, drawings, concepts, or other information (collectively, the "Information"), the Information shall be deemed to become, and shall remain, the property of IWA. None of the Information shall be subject to any obligation of confidence on the part of IWA, and IWA shall not be liable for any use or disclosure of all or part of the Information. Without limiting the foregoing, IWA shall exclusively own all now known or hereafter existing rights to the Information of every kind and nature throughout the world, and shall be entitled to unrestricted use of the Information for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Information.

5. Special Restrictions for Non-Human Visitors. Any Non-Human Visitors to the Web site shall be considered agents of the individual(s) who controls, authors or otherwise makes use of them. The access rights granted to you under the Terms of Use are non-transferable without the express written permission of the owner of the Web site. Special restrictions on a visitor's license to access the Web site apply to Non-Human Visitors. Non-Human Visitors include, but are not limited to, web spiders, bots, indexers, robots, crawlers, harvesters, or any other computer programs designed to access, read, compile or gather content from the Web site automatically. Email addresses on this site are considered proprietary intellectual property. It is recognised that these email addresses are provided for human visitors alone. You acknowledge and agree that each email address the Web site contains has a value not less than AUD $50. You further agree that the compilation, storage, and/or distribution of these addresses substantially diminishes the value of these addresses. Intentional collection, harvesting, gathering, and/or storing this Web site's email addresses is recognized as a violation of this agreement and expressly prohibited.
6. Records of Visitor Use and Abuse. You consent to having your Internet Protocol address recorded. We will use this information to contact the relevant service provider if we suspect potential abuse.

IWA EXPRESSLY DISCLAIMS ANY WARRANTY THAT THE FUNCTIONS CONTAINED IN THE MATERIALS APPEARING ON THIS SITE WILL BE UNINTERRUPTED OR FREE OF ERRORS, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER THAT MAKES THIS SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS. IWA MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, REGARDING THE USE OF THE MATERIALS APPEARING ON THIS SITE WITH REGARD TO THEIR CORRECTNESS, RELIABILITY, ACCURACY, OR OTHERWISE. 8. Governing Law; Invalidity of Separable Provisions; Entire Agreement. This Agreement shall be construed and governed in accordance with the laws of Western Australia State, Australia, regardless of the place or places of its physical execution and performance. Any actions brought by IWA or user based on or arising out of this Agreement shall be brought exclusively in the Australia Court for the Mount Pleasant suburb or in a state court located in said suburb. If any term or provision of this Agreement is for any reason held to be invalid, such invalidity shall not affect any other term or provision, and this Agreement shall be interpreted as if such term or provision had never been contained in this Agreement. This Agreement contains the entire understanding of IWA and user with respect to its subject matter.
