| LC | 1827 | 3 | 21 | NPS | THRUSTOUT | Jack | Jack Thrustout v. Connell.—This wet an ejectment on be title, Lessee William Howe, Stephen, James, Alicia, and Frances Nolan, Plaintiffs, John Connell, Defendant, to recover the house, garden, and plot of ground, in rere of brewery concerns, called the Hospital fields, on the road from Limerick to Cork, near Blackboy turnpike. The lands in question were originally leased by the Corporation of Limerick, in the year 1748, for a term of 40o and 4 score years, to Arthur Roche, at a stipulated rent of £4 per annum. In 1779, the premises appeared to have become the property of John Connell, the elder, on paying the consideration of £140, and he, by his will in 1790, bequeathed them in trust for his wife Barbara, and during her life time to George Smith and John Gabbett, and then to revert to his daughter Christiana Creaghe, sister of Defendant, and sole Executrix. The evidence adduced on this occasion was principally documentary, consisting of the sworn answer of the Defendant to the bill of complaint filed by the Plaintiffs, and on this issue was joined. The Plaintiffs relied for their case on the demise to Christiana, and her will executed in 1815 in favor of her grand-children. Defendant pleaded the statute of limitation and uninterrupted possession for 35 years, and that he had advanced more than the value of the premises to his sister Christiana, who had more than once offered to assign them to him in her life time. His Lordship finally sent the case to the Jury, and, after an hour's consideration, they returned a verdict for Plaintiff's, with 6d costs, finding that the possession of the Plaintiff was only permissive, and not uninterrupted adverse possession as required by law to render it valid. Counsel for Plaintiff—Mr. Bennett, Recorder Waggett, and Mr. Jackson. Agent, John Vincent. Counsel for Defendant .Mr. O'Connell, Mr. Wolfe, and Mr, Howley. Agent, James 0'Shaughnessy. | |

| LGA | 1812 | 4 | 03 | NPS | TUCKEY | Cork April 2:... In the city civil court the case of SULLIVAN against TUCKEY for a breach of promise of marriage, occupied the court from four o'clock to nine at night of Friday. It appeared the plaintiff was a servant in the house of the father of defendant, receiving wages of two guineas a yearthe young gentleman had just returned from college, and having become deeply enamoured with his fair desdemona, wrote some very loving letters, which did much more credit to the galantry of his heart than the sagacity of his head it appeared that the birth of a lovely babe was the consequence of the attachment in consequence of the interference of his friends, the young gentleman was induced to give up all hopes of enjoying Miss SULLIVAN as his bride but she was determined not to be treated so cavalierly with impunity, and therefore brought her action. Mr Serjeant M'MAHON, in a very able speech maintained the maid was the seducer and the young man seduced but the jury, it seems, thought otherewise, for they returned a verdict of 100 guineas against the defendant | ||
