LC1825907NPSCLEARYJamesMrA very melancholy occurrence took place this week, which has occasioned real concern to the numerous friends of Mr. James CLEARY, a respectable and wealthy resident of Kilmallock. This Gentleman was discovered yesterday morning, lying dead on the bridge of Kilfinnan, whit his brains dashed out and other marks of violence on his person. It was first apprehended that he fell victim to the ill-fated spirit of disturbance again evidencing itself in the County, but on a minute investigation of all the circumstances and with the aid of medical advice, it was ascertained that he was by some accident thrown from a vicious mule he was riding, and kicked repeatedly by the animal until deprived of life.

Stolen on the Night of Thusday last, the 2d Instant, from off the lands of Gibbingstown, near Kilmallock, in this County, a very bon bright Bay three year old Horse Colt, about fifteen hands and a half high, light and fashionable, the property of John CLEARY of Gibbingstown aforesaid, who will pay a Reward of Five Guineas to any Person or Persons who may apprehend the Horse and Thief, and presecute him to conviction. Said Colt has a sore tail, in consequence of a cut he got for the purpose of bleeding him.
Dated at Gibbingstown this 4th Sept. 1824.
LC1826128NPSCLEARYJohn John CLEARY is next brother to the man who was killed a short time ago by falling from his horse nea the bridge of Kilfinan, and succeeded to his property which is about 400l. a year.—He was arrested on Thursday evening in a place called Garryspellane in this county, by an active and confidential agent of Thomas P. VOLES, Esq. after a fatiguing excursion—His father-in-law, whose name is KEAYS, charged as a principal in the same crime, has likewise been arrested in Dublin, by the exertions of Mr. VOKES—Several persons it appeared claimed an interest in the above mentioned property, for which CLEARY was disputing, and in an affray arrising out of it, the murder was committed, while another man named MADDEN, was so desparately beaten on the same occasion, that he presents a miserable and revolting example of the most savage and barbarous cruelty.

Child Murder
Ann ROCHE, an old woman, of very advanced age, was indicted for the murder of Michael LEAHY, a young child by drowning him in the Fleak. This case, which at ... assumed a very serious aspect, from the meaning imported to words spoken by the prisoner, "that the sin of the child's death was on the grand-mother, and not on the prisoner, and not on the prisoner," turned out to be a homicide committed under the delusion of the grossest superstition. The child, the four year old, could neither stand, walk, or speak—was thought to be Fairy struck—and the grand-mother ordered the prisoner and one of the witnesses, Mary CLIFFORD, to bathe the child every morning, in that pool of the river Fleak, where the boundaries of three farms met; they had so bathed it for three mornings, and on the last morning the prisoner kept the child longer under the water than usual, when her companion (the witness, Mary CLIFFORD) said to the prisoner, "how can you hope to see God after this," to which the prisoner replied "that the sin was on the grand-mother and not on her." Upon cross examination, the witness said it was not done with the intent to kill the child, but to cure it—to get the Fairy out of it
The Policeman, who apprehended her, on charging her with drowning the child, she said it was no matter as it had died four years ago.
Baron PENNEFATHER said, though it was a case of suspicion, and required to be thoroughly examined into, yet the Jury would not be safe in convicting the prisoner of murder, however strong the suspicion might be.
  Verdict—Not Guilty
In this case, Counsel for the Crown prosecuted.
The prisoner was defended by Messrs. O'CONNELL and H. WALSHE.
